Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of HomeBodies’ website, mobile apps, and related services (collectively, the “Platform”). By using the Platform, you agree to these Terms and confirm that you are at least 18 years of age.

2. Our Role

HomeBodies is a technology platform that helps connect Homeowners (those offering rental properties) with Tenants (those seeking rental properties).

• HomeBodies is not a landlord, real estate agent, property manager, insurer, or financial advisor.
• Any lease or rental agreement formed is strictly between the Homeowner and Tenant.
• HomeBodies may provide optional tools (e.g., listings, messaging, tenant screening, lease templates, and payment processing), but it does not guarantee or endorse any property, user, or transaction.

3. Accounts

• You must create an account to access certain features.
• You agree to provide accurate and complete information and to update it as needed.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• HomeBodies may suspend or terminate accounts for misuse, fraud, or violation of these Terms.

4. Listings & Content

• Homeowners are responsible for ensuring all property listings are complete, accurate, and lawful.
• Listings must not contain false, misleading, or discriminatory information.
• HomeBodies may edit, refuse, or remove any listing or content at its discretion.
• Tenants are responsible for reviewing property details, rules, and lease terms before entering into any agreement.

5. Screening, Leases & Payments

• HomeBodies may provide tools for tenant screening (e.g., credit or background checks), standard lease templates, and payment processing.
• These tools are optional and provided “as-is.” They are not legal, financial, or professional advice.
• Homeowners and Tenants are responsible for compliance with applicable laws, including residential tenancy and privacy regulations.
• Payments processed through the Platform may involve third-party providers. HomeBodies is not responsible for delays, errors, or disputes related to third-party payment services.

6. Conduct

When using the Platform, you agree not to:

• Violate any laws or regulations.
• Post or transmit harmful, offensive, or fraudulent content.
• Harass, threaten, or abuse other users.
• Interfere with the security or operation of the Platform.

7. Intellectual Property

All intellectual property on the Platform, including software, design, trademarks, and content, is owned by HomeBodies or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal rental purposes only.

8. Disclaimers

• The Platform and its features are provided “as-is” without warranties of any kind, express or implied.
• HomeBodies does not verify or guarantee the accuracy of listings, the suitability of users, or the success of any rental agreement.
• HomeBodies is not liable for disputes, damages, or losses arising from interactions between Homeowners and Tenants.

9. Limitation of Liability

To the fullest extent permitted by law, HomeBodies’ total liability for any claim related to the Platform will not exceed the greater of:

• (a) CAD $100, or
• (b) the total amount of service fees you paid to HomeBodies in the 12 months prior to the claim.

10. Indemnification

You agree to indemnify and hold HomeBodies, its directors, employees, and partners harmless from any claims, damages, or expenses arising out of your use of the Platform, your violation of these Terms, or your dealings with other users.

11. Changes to Terms

HomeBodies may update these Terms from time to time. If material changes are made, we will notify you by email or through the Platform. Continued use after changes take effect constitutes acceptance.

12. Termination

HomeBodies may suspend or terminate your access at any time if you violate these Terms or misuse the Platform. You may also delete your account at any time. Termination does not affect any obligations that existed prior to termination (e.g., unpaid amounts).

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in British Columbia.
