1. Introduction
These Terms of Service (“Terms”) govern your access to and use of HomeBodies’ website, mobile apps, and related services (collectively, the “Platform”). By using the Platform, you agree to these Terms and confirm that you are at least 18 years of age.
2. Nature of the Platform
HomeBodies is a technology platform that facilitates introductions between individuals offering rental accommodations (“Homeowners”) and individuals seeking rental accommodations (“Tenants”).
- HomeBodies is not a landlord, property manager, real estate broker, leasing agent, or housing provider.
- HomeBodies is not a party to any lease, rental agreement, sublease, roommate agreement, or housing arrangement formed between users.
- HomeBodies does not own, manage, control, inspect, or endorse any listed property.
- HomeBodies does not guarantee the suitability, safety, legality, quality, or availability of any listing or user.
Any lease, tenancy, roommate arrangement, or related agreement is entered into solely between the Homeowner and Tenant. HomeBodies is not involved in negotiating, drafting, enforcing, or terminating any such agreement.
3. No Professional Advice
HomeBodies does not provide legal, financial, housing, tenancy, real estate, credit, or background verification advice.
Any templates, tools, screening features, payment tools, messaging systems, or informational materials made available through the platform are provided for convenience only and do not constitute professional advice.
- Users are solely responsible for conducting their own due diligence.
- Users are solely responsible for verifying identity and property information.
- Users are solely responsible for ensuring compliance with applicable laws, including the Residential Tenancy Act (or equivalent legislation in their jurisdiction).
- Users are solely responsible for obtaining independent legal or professional advice where appropriate.
4. User Responsibility & Due Diligence
HomeBodies does not:
- Verify the accuracy of listings or user representations.
- Conduct background checks unless explicitly stated.
- Guarantee that a user will enter into a rental agreement.
- Guarantee that a property is legally rentable.
- Guarantee the financial stability, reliability, or conduct of any user.
Users acknowledge that:
- All information is provided by other users and may be incomplete, inaccurate, or outdated.
- They are solely responsible for evaluating whether to enter into any housing arrangement.
- Any decision to engage with another user is made at their own risk.
5. Disputes Between Users
HomeBodies is not responsible for disputes between users.
In the event of any disagreement, damage claim, breach of lease, discrimination claim, or tenancy dispute, the matter is solely between the involved parties.
HomeBodies has no obligation to mediate, resolve, or participate in such disputes.
6. Third-Party Services
The platform may integrate or reference third-party services (including but not limited to payment processors, identity verification services, communication services, or document storage providers).
- HomeBodies is not responsible for the actions, errors, availability, or policies of third-party providers.
- Any engagement with such services is governed by the third party’s terms.
7. Intellectual Property
All intellectual property on the Platform, including software, design, trademarks, and content, is owned by HomeBodies or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal rental purposes only.
8. Disclaimers
- The Platform and its features are provided “as-is” without warranties of any kind, express or implied.
- HomeBodies does not verify or guarantee the accuracy of listings, the suitability of users, or the success of any rental agreement.
- HomeBodies is not liable for disputes, damages, or losses arising from interactions between Homeowners and Tenants.
9. Limitation of Liability
To the fullest extent permitted by law, HomeBodies’ total liability for any claim related to the Platform will not exceed the greater of:
- (a) CAD $100, or
- (b) the total amount of service fees you paid to HomeBodies in the 12 months prior to the claim.
10. Indemnification
You agree to indemnify and hold HomeBodies, its directors, employees, and partners harmless from any claims, damages, or expenses arising out of your use of the Platform, your violation of these Terms, or your dealings with other users.
11. Changes to Terms
HomeBodies may update these Terms from time to time. If material changes are made, we will notify you by email or through the Platform. Continued use after changes take effect constitutes acceptance.
12. Termination
HomeBodies may suspend or terminate your access at any time if you violate these Terms or misuse the Platform. You may also delete your account at any time. Termination does not affect any obligations that existed prior to termination (e.g., unpaid amounts).
13. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in British Columbia.
